De esta forma s\u00e9 produc\u00edan gases venenosos, sulfito de hidrogeno, y metano. Cuando el marinero que falleci\u00f3 fue ordenado reparar el sistema, esto resulto en un escape de aguas negras que lleno la letrina hasta el nivel de sus rodillas. Estos gases causaron que el marinero perdiera el conocimiento entre 10 a 15 segundos y despu\u00e9s falleci\u00f3. Este incidente causo la muerte a cuatro marineros y lesiones a otros tres. Los casos de los otros tres marineros que perdieron la vida, ya son hab\u00eda llagado a un acuerdo anteriormente. Este caso fue el primero que fue a un jurado en la Corte.<\/p>\n\n\n\n<p>Basado en lo anterior, el demandante tambi\u00e9n reclamo que la empresa operaba sin seguridad el sistema de la letrina y requiri\u00f3 que se otorgara tambi\u00e9n compensaci\u00f3n por danos agravados. Basado en el factor que el marinero no era casado y no-tenia hijos, el Juez limito la compensaci\u00f3n disponible a sufrimiento y dolor antes de fallecer, y a danos agravados.<\/p>\n\n\n\n<p>La empresa reclamo que el accidente era inevitable. La empresa tambi\u00e9n reclamo que el marinero hab\u00eda desobedecido ordenes, y que el sistema de tratamiento de aguas negras si estaba cumpliendo con las regulaciones de la Coast Guard. James Best, ingeniero marino y arquitecto, testifico que las aguas negras en la letrina, produjeron gases venenosos. Harry Baxley, experto marino e investigador de este accidente para la Coast Guard, testifico que s\u00e9 hab\u00edan violado las regulaciones aplicables de la Coast Guard. Dr. Bonifacio Flores, medico forense, testifico que el marinero estuvo conciente de 10 a 15 segundos antes de su muerte. Tambi\u00e9n dijo que el sulfito de hidrogeno era m\u00e1s venenoso que el cianuro. Alfred Isaacon, ingeniero, testifico a favor de la empresa, que el sistema de la letrina estaba cumpliendo con las regulaciones de la Coast Guard. Tommy Isakson, el Staff Capit\u00e1n del barco, testifico que la empresa se preocupaba por la seguridad a bordo.
