Mientras servia un almuerzo en el barco, el demandante llevara una bandeja con 16 platos de comida con sus tapas. El tama\u00f1o de la bandeja con los platos encima, obstru\u00eda la visi\u00f3n del demandante para ver que av\u00eda encima de la mesa donde los meseros colocan la bandeja. El asistente del mesero, deb\u00eda mantener la mesa limpia para que el mesero pudiera colocar la bandeja sin problemas. Cuando el demandante llega a su estaci\u00f3n y fue a poner la bandeja con los platos de comida sobre la mesa, sinti\u00f3 que av\u00eda un vaso de agua sobre la mesa. Tratando de no quebrar el vaso con el peso de la bandeja, y tratando de que no se le cayera la bandeja, el demandante trato de balancear la bandeja y la levanto de nuevo, pero mientras hacia esto sinti\u00f3 que algo se rompi\u00f3 dentro de su mu\u00f1eca izquierda.<\/p>\n\n\n\n<p>A resultado del constante dolor en la mu\u00f1eca izquierda del marinero, la empresa decidi\u00f3 bajarlo del barco para darle tratamiento medico. El marinero le dijo a la empresa que \u00e9l quer\u00eda recibir el tratamiento medico en Miami, ya que su hermano estaba viviendo en la Florida. La empresa decidi\u00f3 enviar al marinero a su pa\u00eds, Filipinas, para darle el tratamiento medico. En las Filipinas, el marinero tubo una cirug\u00eda en la mu\u00f1eca izquierda con un medico que le consigui\u00f3 la empresa. Despu\u00e9s de la cirug\u00eda, el marinero no pudo mover mas la mu\u00f1eca izquierda. El marinero, por su cuenta decidi\u00f3 ir a Miami para recibir un mejor tratamiento medico. En Miami, la empresa le consigui\u00f3 al marinero una segunda cirug\u00eda, la cual no le mejora la condici\u00f3n de su mu\u00f1eca. Una tercera cirug\u00eda le fue recomendada al marinero por \u00e9l medico que le consigui\u00f3 la empresa en Miami, pero el marinero fue diagnosticado con una condici\u00f3n de Reflex Sympathetic Dystrophy (RSD), en su brazo izquierdo como resultado de la primera cirug\u00eda. Esta condici\u00f3n se le complico con la segunda cirug\u00eda. Al marinero se le recomend\u00f3 controlar primero la condici\u00f3n de RSD, a trav\u00e9s de un manejo de control de dolor, antes de recibir otra cirug\u00eda.<\/p>\n\n\n\n<p>$560,000.00 obtenidos por el
